Special Education Teacher Convicted of Assaulting Students with Disabilities

A special education teacher in Finland received a conviction for assaulting two students with developmental disabilities. The Jämsä court found the 57-year-old woman guilty of six assaults and breach of official duties.

The incidents occurred between February and March at Jämsänjoki Comprehensive School. The teacher assaulted a 13-14 year old student and a 7-year-old student. Both children attended a rehabilitative education class for students with developmental disabilities.

School staff reported the incidents after witnessing concerning behavior. One staff member described hearing a distinct slapping sound during an assault. The witness said the situation seemed so unbelievable they had to confirm with a colleague.

Three assaults targeted the older student. These included slapping bare arms, pushing from behind, and forceful grabbing of hands. The student fell to the floor twice during these incidents.

The younger student experienced three assaults. The teacher pushed the child's tongue back into their mouth, gave them a bone clip for their lip, slapped their hand, and grabbed their arms forcefully.

During one incident, the teacher told a student: "Now you be quiet. The teacher slept so poorly they can't listen to that." This occurred when the teacher grabbed a student who was making noises that might disturb others.

The teacher denied all charges in court. She claimed she didn't remember one situation and denied intending to cause pain or discomfort in others.

Witnesses testified that both students understood speech and responded well to calm explanations and guidance. The court noted the children's personal characteristics made them particularly vulnerable.

The court emphasized that assault doesn't require causing pain. The law protects physical integrity regardless of injury severity. While the violence wasn't severe and caused no significant injuries, the court didn't consider the acts minor given the children's vulnerabilities.

The teacher received 60 day fines totaling 360 euros for six assaults and breach of official duties. No compensation claims were filed. The September verdict is final and the teacher no longer works for Jämsä city.

This case highlights the critical importance of proper student treatment in special education settings. The teacher's explanation about poor sleep reflects poorly on professional standards expected in Finnish schools.
